Terms of Service

1. Agreement to Terms

By downloading, accessing, or using Hobbal (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Hobbal is provided by Hobbal ("Company," "we," "us," "our").

2. Eligibility

• You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create a Hobbal account.
• Hobbal is a household coordination tool. Account holders may enter and store information about other people they care for — including children, older family members, or dependents — such as meal preferences, habit tracking, or care reminders. By entering such information, you confirm you are the parent, legal guardian, or otherwise authorized to do so, and you are responsible for that data.
• Hobbal itself is not directed at children and is not designed for direct use by children. See our Privacy Policy for details on children's data.

3. Use License

We grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial purposes. You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with the operation of the App or impair its functionality
• Reproduce, distribute, or transmit any content without permission
• Use the App to harass, abuse, or harm others

4. Account Responsibility

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information during registration
• You are liable for all activity under your account
• You agree to notify us immediately of unauthorized access at hello@hobbal.com

5. Household Sharing

• Hobbal is designed for household members (e.g., couples, family units) to collaborate
• All members of a household share access to shared data (meals, habits, tasks, moments, grocery lists)
• Each member is responsible for their own account security
• The household creator may manage household settings and invite members

6. User Content & Intellectual Property

Your Rights

• You retain ownership of any content you create or upload (photos, captions, meal preferences, etc.)
• You grant Hobbal a non-exclusive license to use, store, display, and process your content to provide the App's services

Our Rights

• Hobbal owns all intellectual property in the App, including design, code, features, and branding
• You may not use Hobbal's name, logo, or branding without written permission

Photos & Moments — Not a Storage or Backup Service

• The Moments feature lets you upload and share photos within your household. Hobbal is not a photo backup, archival, or cloud storage service. Do not rely on Hobbal as the sole or primary copy of any photo — keep your own copies elsewhere.
• We do not guarantee that photos or any other content will be retained indefinitely, and we are not liable for loss of photos or content for any reason, including feature changes, technical failure, or account/household deletion.
• As with any feature of the App, Moments may be modified, limited, or discontinued at any time in accordance with Section 12 (Service Availability & Changes).

7. AI-Generated Content

• Hobbal uses artificial intelligence (currently OpenAI models) to generate certain content on your behalf, including: meal plan suggestions, photo captions and category tags, and grocery list suggestions. We will describe, in the App or in our Privacy Policy, where AI is used as our use of specific tools or models changes over time.
• You are responsible for reviewing and editing AI-generated content before relying on it.
• Hobbal does not warrant the accuracy, completeness, or suitability of AI-generated content, including but not limited to whether a suggested meal is actually compliant with any stated diet, allergy, or medical restriction. AI-generated dietary and restriction guidance is provided for convenience only and is not verified for allergen or medical safety. If you or anyone you are preparing food for has a food allergy, intolerance, or medical dietary requirement, you must independently verify every ingredient yourself. Do not rely on the App for this purpose.
• You retain ownership of content you create, including edits to AI suggestions.

8. Not Medical, Health, or Nutrition Advice

• Hobbal's meal planning, nutrition-related suggestions, and habit/reminder features (including any reminders that reference medication, wellness routines, or care tasks) are provided for general household organization purposes only.
• Nothing in the App constitutes medical, nutritional, psychological, or other professional advice, diagnosis, or treatment. Hobbal is not a substitute for consulting a qualified physician, dietitian, or other healthcare professional.
• Reminders (including medication-related reminders) are a convenience feature only. We do not guarantee delivery, timing, or reliability of any reminder or notification, and you should not rely on the App as your sole method of tracking anything health- or safety-critical.

9. Limitation of Liability

To the maximum extent permitted by law, Hobbal is provided "as is" and "as available" without warranties of any kind. We disclaim all express and implied warranties, including:

• Merchantability, fitness for a particular purpose, and non-infringement
• That the App will be error-free, uninterrupted, or secure
• That defects will be corrected
• That any content, including photos, will be preserved or available at any future date

In no event shall Hobbal be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, photos, revenue, profits, or business
• Your inability to use the App, or the modification, suspension, or discontinuation of any feature

Even if we have been advised of the possibility of such damages. Your sole remedy is to discontinue use of the App.

10. Indemnification

You agree to indemnify and hold harmless Hobbal, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you create or share

11. Data & Privacy

Your use of the App is governed by our Privacy Policy (see PRIVACY_POLICY.md). By using the App, you consent to our collection and use of data as described therein.

12. Service Availability & Changes

• We may modify, suspend, or discontinue the App, or any feature of the App (including but not limited to Moments/photos, AI-generated suggestions, or any other feature), at any time, with or without notice.
• We are not liable for any modification, suspension, or discontinuation, or for any resulting loss of access to content, including photos.
• We may experience downtime for maintenance or technical reasons.
• This is currently an early-stage product. Features may change, be added, be removed, or behave unexpectedly as we continue to develop the App.

13. Pricing & Paid Features

• Hobbal is currently offered free of charge. This may change. We reserve the right to introduce paid plans, subscriptions, or one-time charges for the App or for specific features — including features that are currently free — at any time.
• Where required by applicable law or by the App Store / Play Store's own policies, we will provide advance notice to existing paying subscribers before a price increase takes effect on their existing subscription. Outside of that specific case, we do not guarantee advance notice before a currently-free feature becomes a paid feature, or before new paid tiers are introduced.
• Continued use of the App after a feature becomes paid, where you choose not to pay, may result in loss of access to that feature.
• Any future paid plans will be governed by additional terms (including billing and refund terms) presented to you before you are charged.

14. Termination

We may terminate or suspend your account immediately, without notice, if:

• You violate these Terms
• You engage in illegal activity
• We believe termination is necessary to protect the App or other users

Upon termination, your right to use the App ceases. Your data may be deleted in accordance with our Privacy Policy.

15. Force Majeure

We are not liable for any failure or delay in performance to the extent caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disaster, war, terrorism, riot, labor conditions, governmental action, internet or telecommunications failure, or failure of third-party service providers (including our cloud hosting, database, or AI providers).

16. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.

17. Dispute Resolution

Before pursuing legal action, you agree to attempt to resolve disputes through informal discussion with us at hello@hobbal.com.

18. Third-Party Services

Hobbal may integrate with third-party services (e.g., Supabase, OpenAI, Hostinger). Your use of these services is subject to their terms and privacy policies. Hobbal is not responsible for third-party services.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

20. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, at our sole discretion, without restriction, including in connection with a merger, acquisition, or sale of assets.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hobbal and supersede all prior agreements and understandings.

22. Changes to These Terms

We may update these Terms periodically. Continued use of the App after changes constitutes your acceptance of the updated Terms. We will notify you of material changes by updating the "Last Updated" date.
